This agreement is being made between you and First Community Bank of the Ozarks and stipulates that you are requesting to be enrolled in First Community Bank of the Ozarks’ Electronic Statements Program (hereafter referred to as E-Statements).

By enrolling in E-Statements, you have requested and First Community Bank of the Ozarks (FCB) has agreed to send you via the email address you provide to FCB, all of your bank account statements electronically through FCB’s secure, encrypted email service, MailSafe. By receiving your statement electronically, you acknowledge that you will be receiving your bank account statement and images of canceled checks via secure, encrypted email (MailSafe) and that no paper copy of the bank account statement will be mailed to you. Your electronic bank account statement will provide the number of each check that has cleared, the amount of each check, the date of payment posting and the image of the canceled check. If you request a paper copy of either your bank statement or any check referenced in that statement, normal research fees will apply. If you request a copy of a check from the Bank, the Bank will provide a legible copy of the check within a reasonable period of time. You have the ability to view your canceled checks for the past thirty (30) days online at FCB Online (FCB’s online banking site).

Please be as specific as possible regarding the information you are requesting. Statements and notices will be mailed to the address we have on file. There is no fee to request a paper copy of a regulatory notice or of the changes of fees or terms on your account. If you wish to have a paper copy of a statement or check, normal research fees may apply.

In the future if you wish to stop receiving your bank account information electronically, you must notify us in writing at the address listed above. This agreement will remain in effect until we receive a written request from you to cancel it.

After enrollment, when your next bank account statement is processed, a secure, encrypted email will be sent to you by Perimeter Mailsafe with an invitation to register with MailSafe and set up a unique password which will allow you to log in and view your bank statement(s). If you forget your password, you will be prompted to have a new password sent to your email address. Once you have reset your password, you will need to contact First Community Bank to have your bank account statement resent.

Once you have accessed your bank account statement with attached images on Mailsafe, you should save it to a folder on your computer as the emails will only be stored in Mailsafe for thirty (30) days. In the event you do not save the bank account statement with attached images and need another copy, please contact First Community Bank and have the bank account statement resent to your email address.

FCB is not responsible for any errors or failures arising from any malfunction of your personal computer or associated software or for any interruption in service due to loss of electricity or internet connectivity. You are solely responsible for scanning your computer hardware and software for computer viruses.

Should your email address change, you agree to inform us of your new email address within five (5) days of your email address changing. Email address changes required completion of a Change of Information form which can be obtained from any FCB location or via email or fax. The completed Change of Information form will need to be delivered in person, via fax or via first class mail to First Community Bank.

By enrolling, you agree to the terms stated above and are able to meet the minimum requirements for printing or retaining the information provided to you. You understand you have a duty to exercise reasonable promptness in examining the electronic statement or the items referenced to determine whether any payment was not authorized because of an alteration of an item or because a purported signature by or on behalf of you or other signatory on the account was not authorized. The statute of limitations governing these responsibilities will commence at the time the email is sent to you by First Community Bank.

FCB will never send you an email message asking you to access our website to enter personal information. If you receive such a message which appears to come from First Community Bank, please contact us by phone or in person to notify us of the email you received.
